Terms of Service

By creating an account, accessing, or using Clevate ('the Platform'), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. This Agreement constitutes a legally binding contract between you and Clevate. If you do not agree with any part of these terms, you must immediately cease all use of the Platform.

You must be at least 13 years of age to hold your own account. If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these terms on your behalf. Accounts for learners under 13 (the Kids Learning Club) must be created or approved by a parent or guardian, who remains responsible for the account and may manage or delete it through the Parent Portal. You agree to provide accurate, current, and complete information during registration and onboarding, and to keep it accurate, because your education pathway determines the workspace and content you receive.

Clevate provides AI-powered educational tools for learners everywhere, including AI tutoring, document summarization, flashcard generation, practice questions, exam simulation, competitive Arena play, and pathway-based workspaces for kids, junior secondary, senior secondary and university students. We serve eight exam boards, and the questions, timing and paper format for each are modelled on that board's published specification — they are original questions written by us, not reproductions of real past papers, and we are not affiliated with any exam board. Features available to you depend on your education pathway and the boards you are preparing for; some tools are deliberately not part of every workspace. We may modify, suspend, or discontinue any part of the Service with reasonable notice where practicable.

Clevate operates on a freemium model. Subscription fees for paid plans are billed in advance for a fixed period of 30 days from the day you pay. Payments are securely processed by a third-party payment processor; we never see or store your card details. Which processor handles your payment depends on where you are: Nigerian and Ghanaian payments are processed by Paystack, and payments from elsewhere are processed by Stripe. Each processor handles your card data under its own privacy policy and PCI-DSS compliance, and we receive only a confirmation that a payment succeeded. By subscribing, you authorize the applicable charges. Fees are non-refundable except where required by law, or where you purchased a service that was materially not provided. We may change pricing with at least 30 days' notice, and existing subscriptions continue at the price you paid until they expire. Prices are shown in your local currency and may differ by market; a price change does not affect a purchase already completed.

Movi Points are a game currency for study. You can buy a subscription with real money, but Movi Points cannot be bought, cannot be withdrawn, cannot be exchanged for money of any kind — naira, dollars, pounds or anything else — and carry no cash value. Nothing you do with Movi Points can make you money or win you a prize, and no payment you make for a subscription can be returned in Movi Points. The Arena, the MP Wallet and its transfers, fees, interest, credit score and shop exist to teach how a closed economy behaves, and they operate entirely inside Clevate with no real-world counterpart. MP is not a deposit, cannot be cashed out, cannot be converted to naira, dollars, pounds or any other currency, and cannot be used to obtain any good, service, prize or reward of value, whether from us or anyone else. We do not sell MP, we do not buy it back, and no subscription payment can be settled in MP. We do not offer cash or cash-equivalent rewards for MP activity.

Your username is your public identity on leaderboards and in social features; it must follow our content rules and may not impersonate others. You may change your profile information in settings; changes to your education pathway can change your dashboard, subjects, exam targets and recommendations, which is why we ask for confirmation on significant changes. You are responsible for all activity under your account and must not share credentials.

The Platform's original content, features, and functionality (including design, logos, and software) remain the exclusive property of Clevate. Your 'User Content' (uploaded PDFs and notes) remains yours. By uploading content, you grant Clevate a worldwide, non-exclusive, royalty-free license to process and analyze that content solely to provide the Service to you. You must not upload material you have no right to use.

Clevate uses artificial intelligence (Google Gemini) to generate study aids. AI can produce inaccurate or incomplete output ('hallucination'). We do not guarantee the accuracy, completeness, or usefulness of any AI-generated output. Cross-reference AI suggestions with your textbooks, teachers and official curricula. Clevate is not responsible for academic outcomes, including exam performance.

You agree not to: (a) reverse engineer, scrape, or overload the Platform; (b) upload copyrighted material you do not own; (c) bypass usage limits defined by your tier; (d) use the Platform to create harmful, offensive, deceptive, or sexual content involving real or fictional minors; (e) harass other learners, manipulate leaderboards or Arena results, or exploit bugs; (f) share account credentials; or (g) access another user's data. We may suspend or terminate accounts that violate these rules.

We aim for high availability but do not guarantee uninterrupted access. Maintenance, outages of third-party providers, or events beyond our control may interrupt the Service. Where feasible we will communicate planned downtime. Free-tier usage limits (for example daily AI requests) may change as the product evolves.

You may delete your account at any time from your profile settings; deletion removes personal identifiers, documents and chat history from primary systems within 30 days, subject to legally required retention (for example payment records). We may suspend or terminate accounts for violations of these Terms, with notice where appropriate. On termination, your licence to use the Platform ends immediately.

To the maximum extent permitted by law, Clevate shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or academic standing, resulting from your access to or use of (or inability to access or use) the Platform. Our total liability for direct claims is limited to the amount you paid us in the 12 months preceding the claim.

We may update these Terms as the product or the law requires. The version date below will always reflect the current agreement, and material changes will be communicated in-app or by email before taking effect. Continued use after changes take effect constitutes acceptance.

These Terms are governed by the laws of the Federal Republic of Nigeria, without regard to conflict-of-law rules, and the competent courts of Nigeria have exclusive jurisdiction. This is a deliberate choice: Clevate is operated from Nigeria, and we are not going to ask a customer in another country to litigate in a jurisdiction we do not understand. Nothing in this section removes any mandatory consumer protection or data protection right you have under the law of your own country, and if a provision of these Terms is unenforceable where you are, that provision will not apply to you rather than the rest of these Terms falling away. If you are a consumer in the UK or the European Economic Area, you keep the benefit of any mandatory local protections that apply to you, and you may bring proceedings in your own country of residence. Before going to court, please contact us first — most disputes are a misunderstanding and are resolved in a message.

Clevate is available internationally, but not every feature or exam board is offered in every country, and the questions we serve are specific to the exam boards named on our site. Prices are set per market and shown in your local currency. If you are resident in a country where our payment processing, tax handling or consumer-protection obligations cannot be met, we may decline a transaction or restrict a feature rather than sell you something we cannot properly support. We will not take payment for a plan we cannot deliver.
